1.1  ESB Distributers operates as an online platform for the sale, delivery, and distribution of products sourced from Worldwide Cosmetics Inc. By using our services, you confirm you are competent and of legal age to enter into a binding contract in the state in which you enter this Agreement with S&S Distributers, LLC.

1.2 You agree to provide accurate, complete, and up-to-date information during the registration and/or checkout process when placing an order. ESB Distributers reserves the right to refuse service, terminate accounts, or cancel orders if any provided information is inaccurate, misleading, or fraudulent.

 

1.3  ESB Distributers may modify or update these Terms and Conditions at any time without prior notice. Continued use of the website after such modifications constitutes your acceptance of the revised terms.

Section 2 – Product Information and Pricing

 

2.1 ESB Distributers aims to provide accurate and detailed product descriptions, including the origin, age, and other relevant information for each item. However, we do not guarantee the accuracy, completeness, or reliability of the product information displayed on our website. Please refer to product labels from the manufacturer.

2.2 Statements made on descriptions outlined on our website or on product labels are provided by Worldwide Cosmetics Inc. and have not been evaluated by the Food and Drug Administration (FDA). These products are not intended to diagnose, treat, or cure any disease. Always consult with your doctor before starting a new dietary supplement program. Products containing CBD are sent by Worldwide Cosmetics Inc. to be third-party tested to confirm the absence of THC; However, the sensitivities of drug testing methodologies may vary.

2.3 ESB Distributers reserves the right to change product prices and availability without prior notice. While we strive to ensure accurate market prices, we do not guarantee lowest prices as each distributor operating under Worldwide Cosmetics Inc holds pricing discretion. Occasional pricing errors may occur. In such cases, we will inform you of the error and provide you with the option to cancel or modify your order. ​

Section 3 – Ordering and Payment

 

3.1 Placing an order on our website (esbdistributers.com) constitutes an offer to purchase the selected products. All orders placed are subject to acceptance by ESB distributers. we reserve the right to refuse or cancel any order at our discretion. 

 

3.2 ESB Distributers accepts various payment methods including all major credit cards, debit cards, and other electronic payment options such as PayPal. By providing payment information you authorize us to charge the specified amount for the products and any applicable taxes or fees.

3.3 In the event of a payment failure, your order may be canceled or suspended until the payment is successfully processed. ESB Distributers does not retain any payment information provided during the checkout process. 

Section 4 – Delivery

4.1 ESB Distributers offers delivery services to specified locations that we are legally eligible to ship to. This includes the Continental United States, Alaska, and Hawaii. Delivery times may vary depending on shipping destination and other factors. At checkout, we will provide an estimated delivery timeframe, but we cannot guarantee specific delivery dates or times.

4.2 You acknowledge that the delivery of CBD products requires the recipient to be of legal age, and that legal age may vary by jurisdiction.

4.3. Delivery fees, along with any applicable taxes or duties, will be calculated and added to the total order amount. These charges will be transparently presented during the checkout process.

4.4. ESB Distributers operates within the legal framework of the jurisdiction in which it operates. If purchasing productions containing CBD, it is your responsibility as the customer to ensure compliance with all applicable local, regional, and national laws and regulations regarding the purchase and use of CBD products.

4.5 By accepting our terms and conditions, you acknowledge and agree that you are solely responsible for understanding and adhering to the specific laws and regulations governing the shipment and importation of CBD products in your jurisdiction. ESB Distributers shall not be held liable for any legal consequences or violations resulting from your failure to comply with such laws.

4.6 ESB Distributers reserves the right to refuse or cancel an order if it believes that the shipment would violate any applicable laws or regulations. In such cases, ESB Distributers will notify you and provide a refund for the canceled order, minus any applicable fees or charges.

Section 5 – Returns and Refunds

5.1 All sales on ESB Distributers are final and are not eligible for return unless specific conditions are met. For full details,  please see our return policy.

5.2 ESB Distributors exercises utmost care in the packaging and shipment of your order to ensure it is delivered in optimal condition. In the event that you receive damaged, defective, or incorrect items, you are required to notify our customer service team within three (3) business days of receipt to request a refund or exchange. We reserve the right to request additional information or photographic evidence to facilitate the claims process and determine the appropriate resolution.

5.3  ESB Distributors reserves the right, at its sole discretion, to deny returns or refunds for reasons including, but not limited to, buyer’s change of mind, subjective taste preferences, or improper storage or handling of the products following delivery.

5.4 Orders returned due to an incorrect address, multiple failed delivery attempts, or refusal by the recipient will be subject to a refund, less a restocking fee of twenty percent (20%) of the order subtotal and any applicable shipping charges.

6.1. ESB Distributors strictly prohibits the use of fraudulent or unauthorized payment methods. By placing an order, you agree not to engage in any activities involving the use of stolen, counterfeit, or unauthorized credit/debit cards or other payment forms.

6.2. ESB Distributors reserves the right to report any fraudulent or suspicious activity to the appropriate authorities and to fully cooperate in any subsequent investigation. If any fraudulent payment is suspected, ESB Distributors may cancel the order, notify the payment provider, and pursue legal action to recover any resulting losses.

6.3. Any attempt to use fraudulent payment methods or engage in unauthorized activities on ESB Distributors' website may result in the termination of your account and could lead to legal action, including potential civil and criminal penalties.
